It should be noted that with respect to U.S. rail transponation. the U.S. Supreme Court has recogIJized that a prjmary purpose of the Carmack Amendment (i.e., the statute provjding the underpinning upon which the system of ljability for loss and damage to transported good~ is based) was to reljeve shippers of the burden of searching for the responsible carner from among those in the transponation chain.
