On 18 September 1990, the Federal Ministry of Interior (Bundesministerium für Inneres) rejected the formal appeal (Berufung) of the author on the basis of information received by the competent District Criminal Court (Landesgericht für Strafsachen Graz) that an international warrant for the author's arrest (Haftbefehl) was still in force.
ولكن المحامي الذي كان يدافع عنه آنذاك قصّر سهواً في طلب تبرير خطي لأسباب القرار المتخذ من شعبة الاستئناف في غضون الأيام العشرة المحددة لذلك، وكانت النتيجة أن رفضت شعبة الاستئناف تقديم مبرراتها عندما طلب إليها ذلك فيما بعد.
