• M. Kälin souscrit à la proposition tendant à voir modifier la première phrase du paragraphe 20 de sorte qu'elle se lise comme suit : « The requirement of competence, independence and impartiality of the tribunal in the sense of article 14, paragraph 1, is an absolute right that is not subject to any exception. » (« La garantie de compétence, d'indépendance et d'impartialité des tribunaux au sens du paragraphe 1 de l'article 14 est un droit absolu qui ne souffre aucune exception »). Il propose de remplacer le texte de la deuxième phrase par le libellé suivant : « The requirement of independence refers in particular to the procedure and qualifications for the appointment of judges and guarantees relating to their security of tenure [] » (« La garantie d'indépendance vise en particulier la procédure de nomination et les qualifications des juges »).
