  ومبدأ قانون السوابق (tesis de jurisprudencia) رقم 1/1996، الذي تمت الموافقة عليه بالإجماع بأغلبية 11 صوتاً في الجلسة العامة لمحكمة العدل العليا في 15 كانون الثاني/يناير 1996 ينص على أن " علاقات الهيئات العامة اللامركزية ذات الطابع الاتحادي مع العاملين فيها لا تخضع لأحكام الجزء باء من المادة 123 من الدستور".
