• Labour strikes in New Caledonia decreased by a third between 1998 and 1999.18 Nonetheless, during the period under review, a number of strikes were led by the l'Union syndicale des ouvriers et employés de Nouvelle-Calédonie (USOENC), by USOENC-Mines and by l'Union syndicale des travailleurs kanaks et des exploités (USTKE), which have principally affected the Doniambo nickel smelter, the media, air transport and a number of businesses owned by Mr. Jacques Lafleur, President of the RPCR party.

• This period was characterized by a threefold wave of violence: (a) that which followed the “release” (i.e., escape) of almost all prisoners; (b) that of the leaders of the popular organizations who, having lost their points of reference, became “free electrons”; and (c) that linked to the emergence of armed groups that have been called the “eleventh-hour workers” (les ouvriers de la onzième heure), who legitimize their criminal activities by practically claiming to be “freedom fighters”.

• The strict liability of the employer is also recognized in France. Under article 1 of the 1898 law concerning liability for industrial accidents to workers (concernant la responsabilité des accidents dont les ouvriers sont victimes dans leur travail), the victim or his representatives are entitled to demand compensation from the employer if, in consequence of the accident, the person concerned is obliged to stop work for more than four days.

In 2002 labour disputes occurred mainly within the mining sector, with the Syndicat des ouvriers et employés de Nouvelle-Calédonie leading strikes at the sites of SLN and SMSP. There was also a two-week strike by radio and television workers in June 2002.34 Another labour-related issue in the news in 2002 stemmed from the entry into force of a unified health insurance scheme covering illness and maternity.
