• Having collected all evidence, if the Investigating Judge concludes that such evidence does not provide legal ground for arraignment, he/she shall transmit the affair to the Procuratore del Fisco for an opinion.

• The examination of all witnesses is followed by the closing arguments of the Procuratore del Fisco and the counsel. Lastly, the accused is also invited to defend him/herself (article 179 of the Code of Criminal Procedure).

• All measures taken by the judge for the execution of criminal judgements can be appealed against either by the Procutarore del Fisco or the convict, or any interested party.
  ويجوز الطعن في كافة التدابير التي يتخذها القاضي المسؤول عن تنفيذ الأحكام الجنائية سواء من جانب المدعي أو المدان أو أي طرف يهمه الأمر.
• If after a final decision newly discovered facts prove the innocence of the convict, the latter (or his/her heir or close relative) or the Procuratore del Fisco may request that the sentence be reviewed by a Judge of Criminal Appeal different from the one who pronounced the second instance decision, as provided for by Law No. 20 of 24 February 2000.
  وإذا جدَّت بعد صدور قرار نهائي وقائع تُثبِت براءة المُدان، يجوز لهذا الأخير (أو وريثه أو قريب لـه) أو طلب قاضي استئناف جنائي غير القاضي الذي أصدر الحكم في محكمة الدرجة الثانية أن يقوم بإعادة النظر في الحكم على النحو المنصوص عليه في القانون رقم 20 الصادر في 23 شباط/فبراير 2000.
• Article 2 of Law No. 4 of 19 January 1989 reads: “During proceedings before either an ordinary court or an administrative tribunal, any of the parties, the Procuratore del Fisco or the judge him/herself may request in writing the verification of the legitimacy of a rule in relation to the principles contained in Law No. 59 of 8 July 1974.
  وتنص المادة 2 من القانون رقم 4 الصادر في 19 كانون الثاني/يناير 1989 على ما يلي: "يجوز لأي طرف من الطرفين في دعوى ينظر فيها أمام محكمة عادية أو محكمة إدارية أو المدعي العام، أو القاضي بذاته أن يقدم, أثناء سير إجراءات الدعوى, طلباً كتابياً يلتمس فيه التحقق من شرعية أي قاعدة ذات صلة بالمبادئ الواردة في القانون رقم 59 الصادر في 8 تموز/يوليه 1974.
• Article 3 stipulates that “the judge shall formally reject the requests submitted by the parties or the Procuratore del Fisco which are evidently groundless or simply dilatory”, by entrusting to the judge before whom the case in which the legitimacy request is pending with the receivability assessment.
  وتقتضي المادة 3 من القاضي "أن يرفض رسمياً الطلبات المقدمة من الأطراف أو من المدعي العام التي يتبدى جلياً أنها بلا أساس أو تعرقل سير الدعوى، بأن يعهد إلى القاضي مهمة تقييم إمكانية قبول الدعوى المعروضة عليه ريثما يبت في طلب التحقق من شرعيتها.
