• Furthermore, the Special Rapporteur would like to draw the attention of the General Assembly to the draft General Comment of the Human Rights Committee on Article 2 of the International Covenant on Civil and Political Rights on “The Nature of the General Legal Obligation Imposed on States Parties to the Covenant” which recalls that “(…) the article 2 obligation requiring that States Parties respect and ensure the Covenant rights for all persons in their territory and all persons under their control entails an obligation not to extradite, deport, expel or otherwise remove a person from their territory, where there is a real [and substantial] risk [i.e., a necessary and foreseeable consequence] [French: réel [et significatif]; S: real [y significativo]] of irreparable harm, such as that contemplated by articles 6 and 7 of the Covenant.
