In its judgement Morris v. the United Kingdom of 26 February 2002, the European Court of Human Rights referred, quite exceptionally, to the case law R. v. Généreux.
وقد رجعت المحكمة الأوروبية لحقوق الإنسان نفسها، بشكل استثنائي تماماً، في الحكم الذي أصدرته في قضية Morris c. Royaume-Uni في 26 شباط/فبراير 2002، إلى حكم القضاء الصادر في قضية R. c. Généreux.
In the case R. v. Généreux tried on 13 February 1992, the Supreme Court of Canada was able to rule that the organization of military tribunals was in contradiction with constitutional principles, particularly with regard to guarantees of independence, without challenging, in this instance, the very principle of military justice.
ورأت المحكمة العليا في كندا، في القضية Rc. Généreux التي صدر الحكم بشأنها في 13 شباط/فبراير 1992، أن تنظيم المحاكم العسكرية يتناقض مع المبادئ الدستورية، لاسيما فيما يتعلق بضمانات الاستقلال، ولم تعترض مع ذلك، في هذه الدعوى، على مبدأ القضاء العسكري في حد ذاته.
