Whether a Party chooses to accept the reservation, or object to the reservation, or object to both the reservation and the entry into force of the treaty as between the reserving and objecting States is a matter for a policy decision and, as such, not subject to the criteria governing permissibility and not subject to judicial review”447 [El problema de la “oponibilidad” es la cuestión secundaria y presupone que la reserva es permisible.
وسواء اختار طرف قبول التحفظ أو الاعتراض عليه أو الاعتراض في آن واحد على التحفظ وعلى دخول المعاهدة حيز النفاذ بين الدولة المتحفظة والدولة المعترضة فإن هذه مسألة اتخاذ قرار للسياسة العامة، وهي بصفتها تلك لا تخضع للمعايير التي تحكم الجواز كما لا تخضع للمراجعة القضائية``(447).
