• o Le paragraphe 2 de l'article 46 de la Convention américaine sur les droits de l'homme (Pacte de San José − Costa Rica) dispose que: «Les dispositions énoncées aux alinéas 1 a) [Que toutes les voies de recours internes aient été dûment utilisées et épuisées conformément aux principes du droit international généralement reconnus] et 1 b) [Que la pétition ou communication soit introduite dans les six mois à compter de la date à laquelle l'individu présumé lésé dans ses droits a pris connaissance de la décision définitive] …» ne seront pas appliquées dans les cas où: a) il n'existe pas, dans la législation interne de l'État considéré une procédure judiciaire pour la protection du droit ou des droits dont la violation est alléguée; b) l'individu qui est présumé lésé dans ses droits s'est vu refuser l'accès des voies de recours internes ou a été mis dans l'impossibilité de les épuiser; ou c) il y a un retard injustifié dans la décision des instances saisies (voir http://www.cidh.org/Relatoria/showarticle.asp?artID=62&lID=3).
  (س) تنص الفقرة 2 من المادة 46 من الاتفاقية الأمريكية لحقوق الإنسان (ميثاق سان خوسيه، كوستاريكا) على أن "أحكام الفقرتين 1(أ) [أن تكون سبل الانتصاف بموجب القانون المحلي قد استخدمت واستنفدت وفقاً لمبادئ القانون الدولي المعترف بها عموما]؛ و1(ب) [أن يكون الملتمَس أو البلاغ قد قُدِّما في غضون فترة لا تتعدى ستة أشهر من تاريخ إخطار الطرف المدعي انتهاك حقوقه بالحكم النهائي]؛ لا تطبق في الحالات التالية: (أ) إذا كان القانون الداخلي للدولة المعنية لا يتيح الإجراءات القانونية السليمة لحماية الحق أو الحقوق المدّعى انتهاكها؛ (ب) إذا حُرم الطرف الذي يدّعي أن حقه قد انتُهك من استخدام سبل الانتصاف المحلية أو مُنع من استنفادها؛ (ج) إذا حصل تأخير لا مبرر لـه في إصدار حكم نهائي بموجب سبل الانتصاف السالفة الذكر".
