• Le 30 mai 2005, une réponse a été reçue du Gouvernement sud-africain. Dans son courrier, ce dernier indique qu'il approuve en grande partie la formulation de la nouvelle définition tout en proposant de modifier comme suit la deuxième phrase du paragraphe 1 b) de l'article premier (version anglaise) : « However, an exception is made where a national of a country affected by the crime is hired to commit the crime in his country of nationality and uses his status as national to conceal the fact that he is being used as a mercenary by the State or organization that hires him ».
  وفي 30 أيار/مايو 2005، وردت رسالة من حكومة جنوب أفريقيا، أوضحت فيها أنها رغم موافقتها إلى حد بعيد على صيغة التعريف الجديد، فإنها تقترح تغييرا في الجملة الثانية من المادة 1، الفقرة 1 (ب) ليصبح نصها كما يلي: ”ولكن تستثنى من ذلك الحالات التي يجري فيها التعاقد مع شخص من رعايا أحد البلدان المتضررة من الجريمة لارتكاب الجريمة في البلد الذي يحمل جنسيته، ويستغل فيها هذا الشخص حمله لتلك الجنسية لإخفاء صفته كمرتزق تستخدمه الدولة أو المنظمة المتعاقدة معه“.
