While noting that the provisions of the Revised Penal Code (Republic Act No. 3815) and the Act to Impose the Death Penalty on Certain Heinous Crimes, which amended the Revised Penal Code (Republic Act No. 7659), explicitly prohibit the imposition of the death penalty on persons below the age of 18 years at the time the crime was committed, the Committee expresses its deep concern at the cases where children, that is persons below the age of 18, have been placed on death row without definite proof of their age.
وبينما تلاحظ اللجنة أن أحكام قانون العقوبات بصيغته المنقحة (المرسوم الجمهوري رقم 3815) والقانون المتعلق بفرض عقوبة الإعدام على جرائم شنيعة معينة، المعدّل لقانون العقوبات بصيغته المنقَّحة (المرسوم الجمهوري رقم 7659)، تمنع منعاً صريحاً تنفيذ عقوبة الإعدام بحق الأشخاص الذين لم يبلغوا سن الثامنة عشرة وقت ارتكاب الجريمة، فإن اللجنة تعرب عن بالغ قلقها إزاء حالات الأطفال، أي الأشخاص دون الثامنة عشرة، الذين ينتظرون تنفيذ حكم الإعدام دون التأكد من سنهم بشكل قطعي.
