Furthermore, recalling that article 14, paragraph 3 (e), does not provide an unlimited right to call any witness requested by the accused or his counsel, the Committee is of the view that the material before it does not disclose that the judgement of the Court of Appeal, subsequently upheld by the Court of Cassation, was of a nature to compromise the application of the principle of the equality of arms of the prosecution and the defence.
وعلاوة على ذلك، وإذ تشير اللجنة إلى أن الفقرة 3(ه) من المادة 14 من العهد لا تقر للمتهم أو لمحاميه حقاً غير مقيد في استدعاء أي شاهد من الشهود، فإنها ترى أن صاحب البلاغ لم يقدم الأدلة الكافية التي تثبت أن قرار محكمة الاستئناف، الذي أقرته محكمة النقض، كان من شأنه أن يحول دون تطبيق مبدأ تكافؤ الوسائل بين الادعاء والدفاع.
