Delivery in accordance with such instructions discharges the carrier from its obligation, even if the negotiable transport document has not been surrendered (or the electronic record is still valid).

In view of the widespread practice of releasing goods without the bill of lading by carriers, the Convention seeks to address the issue of releasing goods without the bill of lading, i.e. when the bill of lading reaches the destination later than the goods, or, due to other reasons, the holder of the bill of lading fails to request the delivery of goods at the time when the goods reach the destination, the carrier is entitled to seek instructions to discharge the goods in the following order from the party controlling the goods, the shipper and the shipper of the bill of lading.
بالنظر إلى انتشار ممارسة إفراج الناقلين عن البضائع من دون سند شحن، تسعى الاتفاقية إلى معالجة مسألة الإفراج عن البضائع من دون سند شحن، أي أنه عندما يصل سند الشحن إلى مكان المقصد بعد وصول البضاعة، أو يتخلف حامل سند الشحن، لأسباب أخرى، عن طلب تسليم البضاعة عندما تصل إلى مكان المقصد، يحق للناقل عندئذ أن يلتمس تعليمات الإفراج عن البضائع، على أن يلتمسها بالترتيب التالي: من الطرف المسيطر على البضائع فالشاحن فالشاحن الحائز على سند الشحن.
