  يجوز للدولة الطرف أيضاً، وقت التصديق أو الانضمام، إصدار إعلان عام بتأخير زيارات اللجنة الفرعية إلى ما يخضع لولايتها أو سيطرتها من الأماكن التي يوجد بها أشخاص محرومون من حريتهم، وذلك لمدة أقصاها عامان من تاريخ سريان البروتوكول الاختياري على تلك الدولة الطرف.
