As regards paragraph (3), it was agreed that parties to the framework agreement should be notified of their selection alone, and that the words “and, where relevant, their ranking” should therefore be deleted.
وفيما يتعلق بالفقرة (3)، اتُّفق على أنه ينبغي إبلاغ الأطراف في الاتفاق الإطاري باختيارهم وحدهم، وأن تحذف بالتالي عبارة "وكذلك بترتيبه (ترتيبهم) عند الاقتضاء".

(3) The procuring entity shall select the supplier(s) or contractor(s) with which to enter into the framework agreement on the basis of the specified selection criteria, and shall promptly notify the selected supplier(s) or contractor(s) of their selection and, where relevant, their ranking.
(3) تختارُ الجهةُ المشترية المورِّد أو المقاول الذي (المورِّدين أو المقاولين الذين) سيُبرم الاتفاقُ الإطاري معه (معهم) استنادا إلى معايير الاختيار المحددة، وتُسارع إلى إبلاغ المورِّد أو المقاول المختار (المورِّدين أو المقاولين المختارين) باختياره (باختيارهم)، وكذلك بترتيبه (ترتيبهم) عند الاقتضاء.

On the one hand, it was said that such an evaluation would be an important step in ensuring the transparency of the application of the criteria and weightings, as it would be followed by a notice to each bidder of the results of that evaluation (the results including whether the bidder was qualified for the ERA, whether the initial bid was responsive, and, if relevant, any ranking or scoring of the bid).
فقد رُئي، من جهة، أن التقييم الأول من شأنه أن يكون خطوة هامة صوب ضمان شفافية تطبيق المعايير والأوزان، بما أن كل واحد من مقدّمي العطاءات سيتلقى بعد ذلك إشعارا بنتائج التقييم (تشمل النتائج ما إذا كان مقدّم العطاء مؤهّلا للمناقصة الإلكترونية، ومدى استجابة العطاء الأولي للشروط، وترتيب العطاء أو درجته، إذا كان ذلك مناسبا).

(3) Unless the procuring entity rejects some or all submissions under articles [12, 12 bis, other cross-references] of this Law, the procuring entity shall select the supplier(s) or contractor(s) with whom to enter into the framework agreement on the basis of the selection criteria to be specified under paragraph (2) (d) above, and shall promptly notify the selected supplier(s) or contractor(s) of their selection and, where relevant, their ranking.
(3) إذا لم ترفض الجهة المشترية بعض العروض المقدمة أو كلها بمقتضى المواد [12 و12 مكررا وغير ذلك من الإحالات] من هذا القانون، يتعين عليها أن تختار المورّدين أو المقاولين الذين ستبرم معهم الاتفاق الإطاري استنادا إلى معايير الاختيار التي تحدَّد في الفقرة 2 (د) أعلاه، وأن تسارع بإبلاغ المورّدين أو المقاولين المختارين بأن الاختيار قد وقع عليهم، وكذلك بالمراتب المعطاة لهم، حيثما كانت لهذا الأمر أهمية.
