MONUC had no direct contractual relationship with the oil company, and the Mission relied on the government-controlled oil company's statements of fuel balances to vendors as evidence that fuel had been reserved for MONUC, without verifying the actual delivery of the fuel.

In its response to the draft report, MONUC explained the circumstances surrounding the prepayment and commented that, as of October 2006, it had recovered $500,000 from the vendor, and that the balance of $1.4 million would be withheld from the vendor's outstanding invoices.

As indicated in paragraph 11 (a) of the report of the Office of Internal Oversight Services (A/61/760 and Corr.1), MONUC had explained that, as of October 2006, it had recovered $500,000 from the vendor, and that the balance of $1.4 million would be withheld from the vendor's outstanding invoices.
