With a view to resolving two recurrent operational problems, the Council requests the Working Group to take into account cases where the actual consignee does not hold the transport document (for example, a blank order bill of lading) and where the transfer of the document is delayed either because of the means of paying for the goods (letters of credit, payment against documents) or because of a late transfer.
ومن أجل حلّ مشكلتين من المشاكل العملياتية المتكرّرة، يطلب المجلس إلى الفريق العامل أن يأخذ في الحسبان الحالات التي لا يكون فيها المرسل إليه الفعلي حائزا لمستند النقل (مثل سند الشحن على بياض) والتي تتأخّر فيها إحالة المستند إما بسبب وسائل دفع ثمن البضاعة (خطابات الاعتماد، الدفع بموجب مستندات) أو بسبب التأخّر في الاحالة.

Under current law this issue has been solved in different ways such as that arbitration clauses in bills of lading are binding on the shipper, because they are regarded as cases sui generis that do not require a written message or signature of the shipper; because the writing requirement is interpreted broadly to cover the practices of issuance of bills of lading; or because the shipper (by preparing and giving to the carrier certain written information to be included in the bill of lading, in particular regarding the description of the goods, or filling out the blank form of a bill which contains an arbitration clause) is considered as having conveyed a written communication to the carrier who in turn signs the bill and gives it to the shipper.
وفي اطار القوانين الراهنة، حلت هذه المسألة بطرائق متباينة، مثل أن تكون شروط التحكيم الواردة في سندات الشحن ملزمة للشاحن، لأنها تعتبر حالات من النوع ذاته ولا تتطلب رسالة مكتوبة أو توقيعا من الشاحن؛ أو لأن اشتراط الكتابة يفسر تفسيرا واسعا بحيث يشمل ممارسات اصدار سندات الشحن؛ أو لأن الشاحن يعتبر (باعداه معلومات مكتوبة معينة ينبغي أن تدرج في سند الشحن، وخصوصا بشأن وصف البضائع، واعطائه تلك المعلومات للناقل، أو بملئه الاستمارة الشاغرة لسند يحتوي على شرط تحكيم) قد وجه رسالة مكتوبة الى الناقل، الذي يوقع بدوره على السند ويعطيه للشاحن.
