The Committee is of the view that, in ruling legally that a particular honour should be granted principally to men and only accessorily to women, the State party is taking a discriminatory position vis-à-vis women of noble families that cannot be justified by reference to historical traditions or historical rights or on any other grounds. The Committee therefore concludes that the ban on sexual discrimination established by virtue of article 26 of the Covenant has been violated in the author's case.
وهذا يثير تساؤلات جدية بموجب العهد، ولا سيما التساؤلات التالية: هل حق جيسيكا في أن تعيش حياة أسرية مع والدتها وشقيقها يمكن أن يطغى عليه حق والدها البعيد الذي مُنح منذ أكثر من عقد الحضانة الدائمة بمفرده دون منح والدتها حق الزيارة؟ وهل إجبارها على العيش مع رجل يُرجح أن تخاصمه في المحاكم ولا تعرفه إلا بوصفه الشخص الذي أراد أن يفصلها عن والدتها وشقيقها هو أمر ينسجم مع حقها في الحصول على تدابير الحماية هذه التي تقتضيها حالتها كطفلة قاصرة؟ وهذان السؤالان، ومعهما أسئلة مماثلة، لهما من الجدية ما يكفي لتبرير إجراء فحص دقيق للأسس الموضوعية للبلاغ.
