• On 4 May 2004, the Ministry of Justice sent the CPA a letter referring to information indicating that Coalition forces responsible for prisoners' affairs were continuing to perpetrate indecent acts against Iraqi prisoners and detainees. The Ministry described these humiliating, immoral and inhuman practices as an expression of moral decay and abhorrent crimes that were condemned in international conventions, particularly subparagraph (a), paragraph 1 of article 2 which is common to the four Geneva Conventions of 1949. Accordingly, the Ministry called on the CPA to set up an independent commission of inquiry, under the supervision of Amnesty International and with Iraqi representatives, to investigate those responsible for committing these shameful acts. It also asked that the Iraqi Department of Corrections (which is responsible for prisons) be allowed to take over the supervision of prisons and prisoners and that an invitation be issued to the International Committee of the Red Cross and the Organization of Red Crescent Societies to visit the prisons and talk to detainees and prisoners.
  خاطبت وزارة العدل الإدارة المدنية لقوات الائتلاف برسالة بتاريخ 4 أيار/مايو 2004 بيّنت فيها أن هناك معلومات تشير أن القائمين على أمور المعتقلات من قوات الائتلاف ما زالوا يرتكبون ممارسات لا أخلاقية في حق المعتقلين والمحتجزين العراقيين، وأن هذه الممارسات المشينة اللاأخلاقية واللاإنسانية تعبّر عن انحطاط أخلاقي وأنها جرائم بشعة تدينها المواثيق والأعراف الدولية وبالأخص المادة (3/أولاً-أ) المشتركة في اتفاقيات جنيف الأربع لعام 1949، ومن هذا المنطق ناشدت الوزارة الإدارة المدنية لسلطة الائتلاف أن يصار إلى تشكيل هيئة تحقيقية مستقلة تشترك فيها الجهات العراقية لإجراء التحقيق مع مقترفي هذه الأفعال المخزية تحت إشراف لجنة العفو الدولية، وأن يفسح المجال أمام دائرة الإصلاح العراقية (المعنية بالسجون) للقيام بدورها في الإشراف على المعتقلات والمعتقلين، وأن تدعى منظمة الصليب الأحمر الدولية ومنظمة الهلال الأحمر الدولية إلى زيارة المعتقلات وتفقد المحتجزين والمسجونين.
