• At the Working Group's fifteenth session, it was suggested that the term “the lowest evaluated bid” should be replaced with the term “the best evaluated bid”, since in practice it was the highest or the best, not the lowest, evaluated bid that was accepted.

• The Working Group agreed with the flexible approach, noting, however, that the words “second lowest price” and “ranked second” in paragraph (2) (c) should be replaced with the words “next lowest price” and “next lowest evaluated bid”, respectively.

• (b) Where the procurement contract is awarded to the lowest evaluated bid, prices and other evaluation criteria specified in the notice of the electronic reverse auction, provided that such other criteria are quantifiable and can be expressed in monetary terms.
  (ب) حيثما يُسند عقد الاشتراء إلى أدنى عطاء مقيّم، فإلى الأسعار ومعايير التقييم الأخرى المحددة في الإشعار بالمناقصة الإلكترونية، شريطة أن تكون هذه المعايير الأخرى قابلة للتحديد كميا ويمكن التعبير عنها نقديا.
• (a) Award the procurement contract to the bidder that, at the closure of the auction, submitted the bid with the next lowest price or next lowest evaluated bid, as applicable; or

• (c) An invitation to present initial submissions together with information referred to in articles [31 (f) to (j) and 33 (a), (k) to (s) and (z)] where the procurement contract is awarded on the basis of the lowest evaluated bid, or where the procuring entity decides that the electronic reverse auction shall be preceded by examination of initial submissions.

• (3) Where the procurement contract is awarded to the lowest evaluated bid, the electronic reverse auction shall be preceded by a full initial evaluation of bids in accordance with the award criteria and the relative weight of such criteria specified in the notice of the electronic reverse auction.”

• (1) The procurement contract shall be awarded to the bidder that, at the closure of the auction, submitted the bid with the lowest price or the lowest evaluated bid, as applicable, unless such bid is rejected in accordance with articles 12, 12 bis, 15 and [36 (…)].

• It has also been suggested that, in the case of open and restrictive tendering, as well as solicitation of price quotations, it would be appropriate to base the award on the determination of the lowest evaluated bid that is also substantially responsive to the bidding documents instead of on the lowest bid price (art. 34, para. 4 (b)(i)) or lowest evaluated tender (art. 34, para. 4 (b)(ii)).
  كما اقترح أنه سيكون من المناسب، في حالة المناقصات المفتوحة والمحدودة، وكذلك في حالة التماس عروض الأسعار، أن يستند إرساء العقد إلى تحديد العرض الأدنى قيمة الذي يستجيب أيضا إلى حد بعيد لوثائق المناقصة بدلا من الاستناد إلى أدنى العروض سعرا (الفقرة 4 (ب) `1` من المادة 34) أو إلى أدنى العروض قيمة (الفقرة 4 (ب) `2` من المادة 34).
