9.3 As to counsel's claim that the constant threat of being returned to a country where he would be in danger of torture, which hung over the complainant for four years, causing him “serious psychological distress”, in itself constituted a form of torture, the Committee recalls its case law to the effect the aggravation of a complainant's state of health following expulsion - or, as in this case, by the threat of return while proceedings are ongoing - does not in itself constitute a form of torture or of cruel, inhuman or degrading treatment within the meaning of articles 1 and 16 of the Convention.
9-3 وبخصوص ادعاء المحامية بأن التهديد المستمر لصاحب الشكوى بترحيله إلى بلد قد يتعرض فيه للتعذيب والذي ظل تحت وطأته لمدة أربعة أعوام وسبب لـه "كرباً نفسياً شديداً"، يمثل بحد ذاته شكلاً من أشكال التعذيب، تذكّر اللجنة بأحكام سابقة لها مفادها أن تدهور صحة صاحب شكوى على إثر طرده من البلد - أو كما في القضية المطروحة، على إثر التهديد بترحيله أثناء النظر في قضيته - لا يمثل في حد ذاته شكلاً من أشكال التعذيب أو المعاملة القاسية أو غير الإنسانية أو المهينة بالمعنى المقصود في المادة 1 أو المادة 16 من الاتفاقية (ي).
