According to article 1108 of the Civil Code of France, the validity of a contract requires the consent of the promisor, his or her legal capacity, a certain object and a licit cause; once these have been met, the contract is “law between the parties” according to article 1134.
ووفقا للمادة 1108 من مدوّنة القوانين المدنية الفرنسية، تقتضي صحة عقد ما توافر رضا الواعد بالالتزام، وأهليته القانونية، وغرض معيّن، وسبب مشروع: ولدى توافر هذه العناصر، يصبح العقد "قانونا بين الأطراف" المعنية، وفقا للمادة 1134.
