It is desirable that situations in which an insolvency law creates special privileges for certain types of claims ranking ahead of security rights (for example, a privilege for payment of tax or other unsecured claims), those privileges be kept to a minimum and clearly stated or referred to in the insolvency law (see recommendation 180 of this Guide).
وفي الحالات التي ينشئ فيها قانون الإعسار امتيازات خاصة لأنواع معيّنة من المطالبات التي تفوق مرتبتها مرتبة الحقوق الضمانية (مثل امتياز دفع الضرائب أو غير ذلك من المطالبات غير المضمونة)، يُستصوب أن تبقى تلك الامتيازات في الحد الأدنى وأن ينص عليها قانون الإعسار أو يشير إليها بوضوح (انظر التوصية 180 من هذا الدليل).
