The human rights of the Palestinian people and other Arabs of the occupied territories are those referred to by the Security Council in its resolution 237 (1967) as “essential and inalienable human rights” and those rights that find their basis in the protection afforded by international law, in particular in circumstances such as military occupation and, in the case of prisoners of war, captivity.
ويشير مجلس الأمن في قراره 237 (1967) إلى حقوق الإنسان للشعب الفلسطيني وغيره من العرب في الأراضي المحتلة بوصفها من ”حقوق الإنسان الأساسية غير القابلة للتصرف“، وتلك الحقوق التي تستند في أساسها القانوني إلى الحماية التي يوفرها القانون الدولي في ظروف محددة مثل الاحتلال العسكري أو الأسْر في حالة أسرى الحرب.

It is not for a prophet to have captives [ of war ] until he inflicts a massacre [ upon Allah ' s enemies ] in the land . Some Muslims desire the commodities of this world , but Allah desires [ for you ] the Hereafter .
لا ينبغي لنبي أن يكون له أسرى مِن أعدائه حتى يبالغ في القتل ؛ لإدخال الرعب في قلوبهم ويوطد دعائم الدين ، تريدون -يا معشر المسلمين- بأخذكم الفداء من أسرى " بدر " متاع الدنيا ، والله يريد إظهار دينه الذي به تدرك الآخرة . والله عزيز لا يُقْهر ، حكيم في شرعه .

ونزل لما أخذوا الفداء من أسرى بدر « ما كان لنبي أن تكون » بالتاء والياء « له أسرى حتى يثخن في الأرض » يبالغ في قتل الكفار « تريدون » أيها المؤمنون « عَرَض الدنيا » حطامها بأخذ الفداء « والله يريد » لكم « الآخرة » أي ثوابها بقتلهم « والله عزيز حكيم » وهذا منسوخ بقوله ( فإما منّا بعد وإما فداءً ) .

Prophet , We have made lawful for you the wives to whom you have given their dowers , as well as those whom your right hand possesses from among the captives of war whom God has bestowed upon you. and [ We have made lawful to you ] the daughters of your paternal uncles and aunts , and the daughters of your maternal uncles and aunts , who have migrated with you ; and any believing woman who gives herself to the Prophet , provided the Prophet wants to marry her . This applies only to you and not to the rest of the believers .
يا أيها النبي إنا أحللنا لك أزواجك اللاتي آتيت أجورهن » مهورهن « وما ملكت يمينك مما أفاء الله عليك » من الكفار بالسبي كصفية وجويرية « وبنات عمك وبنات عماتك وبنات خالك وبنات خالاتك اللاتي هاجرن معك » بخلاف من لم يهاجرن « وامرأةً مؤمنة إن وهبت نفسها للنبي إن أراد النبي أن يستنكحها » يطلب نكاحها بغير صداق « خالصة لك من دون المؤمنين » النكاح بلفظ الهبة من غير صداق « قد علمنا ما فرضنا عليهم » أي المؤمنين « في أزواجهم » من الأحكام بأن لا يزيدوا على أربع نسوة ولا يتزوجوا إلا بوليٍّ وشهود ومهر « و » في « ما ملكت أيمانهم » من الإماء بشراء وغيره بأن تكون الأمة ممن تحل لمالكها كالكتابية بخلاف المجوسية والوثنية وأن تستبرأ قبل الوطء « لكيلا » متعلق بما قبل ذلك « يكون عليك حرج » ضيق في النكاح « وكان الله غفورا » فيما يَعسر التحرز عنه « رحيما » بالتوسعة في ذلك .

يا أيها النبي إنَّا أبَحْنا لك أزواجك اللاتي أعطيتهن مهورهن ، وأبَحْنا لك ما مَلَكَتْ يمينك من الإماء ، مما أنعم الله به عليك ، وأبحنا لك الزواج من بنات عمك وبنات عماتك وبنات خالك وبنات خالاتك اللاتي هاجرن معك ، وأبحنا لك امرأة مؤمنة مَنَحَتْ نفسها لك من غير مهر ، إن كنت تريد الزواج منها خالصة لك ، وليس لغيرك أن يتزوج امرأة بالهِبَة . قد علمنا ما أوجبنا على المؤمنين في أزواجهم وإمائهم بألا يتزوجوا إلا أربع نسوة ، وما شاؤوا من الإماء ، واشتراط الوليِّ والمهر والشهود عليهم ، ولكنا رخصنا لك في ذلك ، ووسَّعْنا عليك ما لم يُوسَّع على غيرك ؛ لئلا يضيق صدرك في نكاح مَن نكحت مِن هؤلاء الأصناف . وكان الله غفورًا لذنوب عباده المؤمنين ، رحيمًا بالتوسعة عليهم .

Subsequently, by its resolution 1291 (2000) of 24 February 2000, the Council authorized the expansion of MONUC and decided that its mandate should be to monitor the implementation of the ceasefire agreement and investigate violations of the ceasefire; to establish and maintain continuous liaison with the field headquarters of the military forces of all the parties; to develop an action plan for the overall implementation of the ceasefire agreement by all concerned; to work with the parties to obtain the release of all prisoners of war, military captives and remains; to supervise and verify the disengagement and redeployment of the forces of the parties; to monitor, within its capabilities and areas of deployment, compliance with the provisions of the ceasefire agreement on the supply of ammunition, weaponry and other war-related materiel to the field; to facilitate humanitarian assistance and human rights monitoring; to cooperate closely with the facilitator of the Inter-Congolese Dialogue; and to deploy mine action experts to assess the scope of the mine and unexploded ordnance problems.
وفي وقت لاحق، أذن مجلس الأمن، بقراره 1291 (2000) المؤرخ 24 شباط/فبراير 2000، بتوسيع البعثة وقرر أن تتمثل ولايتها في رصد تنفيذ اتفاق وقف إطلاق النار والتحقيق في انتهاكات وقف إطلاق النار؛ وإقامة اتصال مستمر مع القيادات الميدانية للقوات العسكرية لجميع الأطراف والحفاظ عليه؛ ووضع خطة عمل من أجل التنفيذ الشامل لاتفاق وقف إطلاق النار من جانب جميع الأطراف المعنية؛ والعمل مع الأطراف على تحقيق إطلاق سراح جميع أسرى الحرب، والأسرى العسكريين والرفات؛ والإشراف على فض الاشتباك وإعادة نشر قوات الأطراف والتحقق منهما؛ والقيام، في حدود قدراتها ومناطق نشرها، برصد الامتثال لأحكام اتفاق وقف إطلاق النار بشأن الإمداد بالذخيرة والأسلحة وسائر العتاد الحربي في الميدان؛ وتيسير المساعدة الإنسانية، ورصد حقوق الإنسان؛ والتعاون الوثيق مع ميسِّر الحوار الوطني؛ ونشر خبراء الأعمال المتعلقة بالألغام لتقييم نطاق مشاكل الألغام والأجهزة غير المنفجرة.

MONUC was to cooperate with the Joint Military Commission on the following mandate: (a) to monitor the implementation of the Ceasefire Agreement and to investigate violations of ceasefire; (b) to establish and maintain liaison with the field headquarters of the military forces of all the parties; (c) to develop an action plan for the implementation of the Ceasefire Agreement; (d) to work with the parties to obtain the release of all prisoners of war, military captives and human remains, in cooperation with international humanitarian agencies; (e) to supervise and verify the disengagement and redeployment of the parties' forces; (f) to monitor compliance within its capabilities and areas of deployment, with the provisions of the Ceasefire Agreement on the supply of ammunition, weaponry and other war-related materiel to the field; (g) to facilitate humanitarian assistance and human rights monitoring, with particular attention to vulnerable groups, including women, children and demobilized soldiers, as MONUC deems within its capabilities under acceptable security conditions, in close cooperation with other United Nations agencies, related organizations and non-governmental organizations (NGOs); (h) to cooperate closely with the facilitator of the national dialogue, to provide support and technical assistance to him and to coordinate the activities of other United Nations agencies to this effect; and (i) to deploy mine action experts to assess the scope of the mine and unexploded ordnance problems, to develop a mine action plan and to carry out emergency mine action activities as required in support of its mandate.
وسوف تتعاون بعثة الأمم المتحــــدة في جمهوريـــة الكونغو الديمقراطية مع اللجنة العسكرية المشتركة في المهام التالية: (أ) رصد تنفيذ اتفاق وقف إطلاق النار والتحقيق في انتهاك وقف إطلاق النار؛ (ب) إقامة اتصال مستمر مع المقار الميدانية للقوات العسكرية التابعة لجميع الأطراف والحفاظ عليه؛ (ج) وضع خطة عمل من أجل تنفيذ وقف إطلاق النار؛ (د) العمل مع الأطراف على تحقيق إطلاق سراح جميع أسرى الحرب، والأسرى العسكريين، والرفاة بالتعاون مع الوكالات الإنسانية الدولية؛ (هـ) الإشراف على فض الاشتباك وإعادة نشر قوات الأطراف والتحقق منها؛ (و) القيام، في حدود قدرات القوة ومناطق نشرها، برصد الامتثال لأحكام اتفاق وقـــف إطــــلاق النـــــار بشأن الإمداد بالذخيرة والأسلحة وسائر العتاد الحربي في الميدان؛ (ز) تيسير المساعدة الإنسانية ورصد حقوق الإنسان، مع إيلاء اهتمام خاص للفئات الضعيفة بمن فيها النساء، والأطفال، والجنود الأطفال المسرحون، في حدود قدرات البعثة وفي ظل ظروف أمنية مقبولة، وبالتعاون الوثيق مع وكالات الأمم المتحدة الأخرى، والمنظمات ذات الصلة والمنظمات غير الحكومية؛ (ح) التعاون الوثيق مع ميسر الحوار الوطني وتزويده بالدعم والمساعدة التقنية، وتنسيق أنشطة الوكالات الأخرى التابعة للأمم المتحدة في هذا الصدد؛ (ط) نشر خبراء الأعمال المتعلقة بالألغام لتقييم نطاق مشاكل الألغام والذخائر غير المتفجرة، وتنسيق أنشطة الأعمال المتعلقة بالألغام ووضع خطة خاصة بهذه الأعمال، وتنفيذ أنشطة الطوارئ المتعلقة بها التي يقتضيها الوفاء بولايتها.
