فقد وافقت كل دولة طرف على أن يكون بوسع الدول الأطراف الأخرى أن تمارس ولايتها القضائية على مرتكبي التعذيب المفترضين من الموظفين الرسميين الموجودين داخل أقاليمها، وذلك إما بتسليمهم أو بإحالتهم إلى سلطاتها المختصة لأغراض المحاكمة؛ وبالتالي، أرى أنه لا يمكنها في الوقت نفسه أن تطلب حصانة من التسليم أو المحاكمة تستند بالضرورة إلى الطابع الرسمي للتعذيب المُدعى ارتكابه و يقال أن أي تنازل من جانب الدول على الحصانات يجب أن يكون صريحا، أو على الأقل بيِّنا.
