• The representative of the Government of Canada explained that its experience with modern treaty-making indicates that the following features are important for effective treaty-making processes: legitimacy with both aboriginal and non-aboriginal citizens; a domestic legal foundation which provides recognition of aboriginal rights in a manner which is compatible with the legal and constitutional structure of the State; a focus on more than legal reconciliation; treaties must establish the foundation for new political, social and economic relationships which will improve the social conditions of aboriginal peoples; achievement of political support requires public education and demonstration that treaties provide mutual benefit to aboriginal and non-aboriginal citizens; political commitment and mandating at the highest levels within the State.
  وأوضح ممثل حكومة كندا أن تجربة بلده فيما يخص وضع معاهدات حديثة تبين أن العناصر التالية هي عناصر هامة لجدوى عمليات وضع المعاهدات: الاعتراف بشرعية مشاركة كل من مواطني الشعوب الأصلية وغير الأصلية؛ وتوفر أساس قانوني محلي ينص على الاعتراف بحقوق السكان الأصليين بأسلوب لا يتعارض مع الهياكل القانونية والدستورية في الدولة؛ والتركيز على أمور تتجاوز مجرد التوفيق القانوني؛ ووجوب أن تُرسي المعاهدات الأساس لعلاقات سياسية واجتماعية واقتصادية جديدة تعمل على تحسين الظروف الاجتماعية للشعوب الأصلية؛ واشتراط الحصول على الدعم السياسي من خلال تعميم التعليم وإثبات أن المعاهدات توفر المنفعة المتبادلة للمواطنين الأصليين وغير الأصليين؛ والالتزام السياسي واتخاذ القرارات السياسية على أرفع المستويات داخل الدولة.
