In cases where a State Party's lead anti-corruption agency receives information sufficient to constitute grounds to investigate whether certain high officials of the country such as the President or the Vice-President may have violated any criminal law under its jurisdiction and where the head of that agency determines that any investigation or prosecution by him or her may result in a personal, financial or political conflict of interest, he or she shall be required to appoint an independent counsel.
وفي الحالات التي يتلقى فيها أحد أجهزة مكافحة الفساد الرئيسية التابعة للدولة الطرف ما يكفي من المعلومات التي تشكل أساساً للتحقيق فيما إذا كان بعض كبار المسؤولين في البلد كالرئيس أو نائب الرئيس قد انتهكوا أي قانون جنائي في إطار الولاية القضائية لذلك الجهاز، والحالات التي يقرر فيها رئيس ذلك الجهاز أن إجراءه أي تحقيق أو ملاحقة قد يؤدي إلى تضارب المصالح الشخصية أو المالية أو السياسية، يتعيّن عليه أن يعيّن مستشاراً قانونياً مستقلاً.
