  ففي حالة التآمر ضد سلطة الدولة تُفرض هذه العقوبة على المدبّر وعلى المخطط أو الفاعل الأصلي في أي حركة مسلحة تهدف إلى الإطاحة بالجمهورية؛ وفي حالة الخيانة العظمى تُفرض على المواطن الذي يهرب إلى بلد أجنبي من أجل الإطاحة بالجمهورية؛ وفي حالة الإرهاب تُفرض على شخص يتبين أنه مذنب بجرائم إرهابية شديدة الخطورة ضد الكوادر والمواطنين بهدف معارضة الجمهورية؛ وفي حالة الخيانة القومية تُفرض على المواطنين الكوريين الذين يعارضون التحرر الوطني والكفاح الثوري وذلك بالتعامل مع الإمبرياليين والعمل تحت إشرافهم، أو المواطنين الذين يخونون الأمة الكورية ببيع مصالحها؛ وفي حالة القتل العمد المقترن بظروف مشددة تفرض على من يرتكب أي جريمة بسبب الجشع أو الغيرة أو البواعث الأساسية الأخرى أو من أجل إخفاء جريمة خطيرة، وفي حالة القتل بأساليب وحشية أو بأساليب تعرض للخطر حياة عدد من الناس، أو في حالة قتل شخص أو أكثر من شخص من الذين يعولوهم أو الذين يخضعون لسلطته أو رعايته.
