As for the second reservation, concerning compensation for a miscarriage of justice, the Egyptian legal system makes no such provision. There are legal procedures in place to guarantee the dispensation of justice and allow for proceedings to be brought against a judge for making a professional error and for recusal of a judge. This system recognizes the right to claim compensation from a person guilty of making a professional error. In addition, the Egyptian legal system criminalizes forgery and false testimony that may result in an injustice being done to others.
أما التحفظ الثاني فهو خاص بالتعويض عن إساءة تطبيق العدالة حيث إن النظام القانوني في مصر لا يعرف هذا النظام إذ توجد إجراءات قانونية خاصة بضمان تطبيق العدالة تتعلق بمخاصمة القضاة في أحوال الخطأ المهني وردهم عن نظر الدعاوى ويخول هذا النظام المطالبة دائماً بالتعويض من المتسبب في خطأ قضائي، فضلاً عن ذلك يوفر النظام القانوني المصري المساءلة الجنائية في أحوال التزوير والشهادة الزور والذي قد يترتب عليها أضراراً قضائية بآخرين.
