The regulations relating to the maintenance and management of the minor's money and property also give priority consideration to the protection and the best interests of the child. For example, article 11 of the Law on Obligations and Contracts provides that a father's disposal of a minor's money and property shall be subject to judicial supervision. It stipulates that a father who manages money and property belonging to his minor or handicapped child requires the permission of the judge for any disposal of such money or property
والقواعد التي تتعلق بصيانة أموال القاصر والولاية على أمواله، من شأنها حماية الطفل ومصالحه، وخير دليل على ذلك إخضاع تصرفات الأب في أموال ولده للرقابة القضائية، حسب مقتضيات المادة 11 من ظهير الالتزامات والعقود التي تنص على أن الأب الذي يدير أموال ابنه القاصر أو ناقص الأهلية، لا يجوز لـه أن يجري أي عمل من أعمال التصرف على هذه الأموال إلا بعد الحصول على إذن خاص من القاضي المختص.
