• If he dies while she is in the period of waiting which follows irrevocable divorce, she shall observe either the period of waiting which follows death or that which follows irrevocable divorce, whichever is the later.

  والطلاق البائن على نوعين: الطلاق البائن بينونة صغرى ويقع لأقل من ثلاث مرات، ويمكن للزوج أن يستعيد زوجته بعقد ومهر جديدين، والطلاق البائن بينونة كبرى، بحيث لا يجوز للرجل أن يستعيد زوجته إلاّ إذا تزوجت المطلَّقة من غير مطلِّقها .
• Article 5 states that Kuwaiti nationality may be granted to a child born to a Kuwaiti woman if the father is a non-Kuwaiti who has irrevocably divorced the mother or is deceased. By ordinance of the Minister of the Interior, minors who fulfil these conditions may be treated as Kuwaitis until they reach the age of majority.
  وقد جاء في المادة الخامسة أنه يجوز منح الجنسية الكويتية للمولود من أم كويتية إذا كان أبوه الأجنبي مطلقا أمه طلاقا بائنا أو توفى عنها، ويجوز بقرار من وزير الداخلية معاملة القصر ممن تتوافر فيهم هذه الشروط معاملة الكويتيين لحين بلوغهم سن الرشد.
• In particular, the Committee is concerned that the Nationality Act allows Kuwaiti women to transfer their nationality to their children only in specific circumstances, such as when the nationality of the father is unknown or if he is stateless or deceased, or after an irrevocable divorce.
  وتشعر اللجنة بالقلق بوجه خاص لأن قانون الجنسية لا يسمح للمرأة الكويتية بنقل جنسيتها إلى أطفالها إلا في ظروف محددة، منها عندما تكون جنسية الأب غير معروفة أو يكون بدون جنسية أو متوفى أو بعد طلاق لا رجعة فيه.

• The two arbiters shall make every effort to reconcile the couple. If they prove incapable of doing so and the husband is wholly or mainly responsible for the maltreatment, they shall decide that the couple should be separated by irrevocable divorce.
  يبذل الحكمان جهدهما في الإصلاح بين الزوجين فإذا عجزا عنه وكانت الإساءة أو أكثرها من الزوج قررا التفريق بطلقة بائنة.
• Divorce is of two kinds. Revocable divorce is when the marital bond is dissolved only after the expiry of the waiting period, during which time the husband has the right to take his wife back, even without her consent. Irrevocable divorce is where the marital bond is dissolved finally and is of two kinds.
  والطلاق نوعان: الطلاق الرجعي، وفيه لا تحلّ الرابطة الزوجية إلاّ بعد انقضاء فترة العدّة، وللزوج أن يرجع زوجته خلال هذه الفترة حتى بدون موافقتها، والطلاق البائن، وفيه تحـلّ الرابطة الزوجية بشكل نهائـي.
• Also, the person divorced must have had 15 years of married life before an irrevocable court decision of divorce.
  • كذلك لا بد أن يكون الشخص المطلق قد أمضى 15 سنة من الحياة الزواجية قبل صدور حكم نهائي من جانب المحكمة بالطلاق.
