  يتعين على الدول أن تضع آليات إجرائية لتيسير الإنفاذ الفعال والناجع من جانب الدائن المضمون، وحماية حقوق المانح والأطراف الثالثة التي لها حقوق في الموجودات المرهونة، دون اعتبار لما إن كان الدائن المضمون: (أ) يجب عليه أن يحصل على حكم قضائي بالطريقة العادية وأن يستعين بموظف عمومي للحجز على الموجودات المرهونة وبيعها في مزاد علني؛ أم (ب) يمكنه الحصول على انتصاف قضائي معجَّل للاعتراف بتقصير المدين، ثم يمكنه المضي فورا إلى الاستعانة بموظف للحجز على الموجودات المرهونة وبيعها؛ أم (ج) يحق له إنفاذ حقوقه دون إجراءات قضائية.
