  بيد أنه في حالة الحقوق الضمانية في الممتلكات الشخصية الملموسة، تنص قوانين كثير من البلدان على أنه يجب "نزع حيازة" المدين عن تلك الممتلكات اذا ما أُريد استخدامها كرهنية - أي أنه يجب أن يحتفظ الدائن، إما بنفسه وإما من خلال وكيل، بالحيازة المادية على الممتلكات لكي يحصل ذلك الدائن على حق ضماني في الممتلكات يكون له أولوية على سائر دائني المدين ويظل نافذ المفعول في اجراءات دعوى الاعسار.
