  قضت المحكمة الدستورية العليا بعدم دستورية النصوص التشريعية المتعلقة بإجراء الانتخابات العامة سواء لمجلس الشعب أو مجلس الشورى أو المجالس المحلية والتى تتم عن طريق القوائم الحزبية فقط لما فيه من حرمان غير المنتمين لأحزاب من المشاركة فيها وذلك يعد مخالفة لأحكام المواد 8 و40 و62 من الدستور (الحكم الصادر بجلسة 16/5/1987 في الدعوى رقم 131 لسنة 6 قضائية دستورية بالنسبة لقانون مجلس الشعب والحكم الصادر في الدعوى رقم 14 لسنة 8 قضائية دستورية، جلسة 15/4/1989، بالنسبة لقانون الحكم المحلي والحكم الصادر في الدعوى رقم 23 لسنة 8 قضائية دستورية، جلسة 15/4/1989، بالنسبة لقانون مجلس الشورى).
