• The relevant provisions of the Act in this context are: Section 6 Preventive safety measures and maintenance which contains general obligations for the owner and user of constructions, Section 19 which concerns safety in enterprises in general, Section 20 which concerns level of safety in enterprises which handle hazardous substances etc. and Section 42 which is a Penal Clause.
  وأما الأحكام ذات الصلة ضمن هذا القانون في هذا السياق فهي: المادة 6، تدابير السلامة الوقائية والصيانة التي تحتوي على التزامات عامة تترتب على مالك ومستخدم الإنشاءات، المادة 19 التي تتعلق بالسلامة في المؤسسات التجارية بشكل عام؛ المادة 20، التي تتعلق بمستوى السلامة في المؤسسات التجارية التي تتعامل مع مواد خطرة إلخ، والمادة 42، التي هي أحكام جزائية.
• Prohibited activities addressed in resolution 1540 (2004) but not covered by the Biological and Toxin Weapons Convention, namely, use, participation as an accomplice and financing, had a lower rate of coverage in framework legislation than in penal legislation, as the latter provides general penal clauses linked with a variety of criminal offences and by that is also applicable to activities related to weapons of mass destruction.

• Also parallel to the regulations in the Turkish Penal Code, the first clause of Article 2 of “The Law on the Enforcement of Penal and Security Measures” states that the rules regarding the enforcement of penal and security measures shall be enforced without any discriminatory notion on the basis of race, language, religion, sect, nationality, colour, sex, political or other opinion, philosophical belief, national or social background, birth, economic and other social status and no one shall be granted any privileges in the application thereof (For regulations regarding discrimination in Labour Law, see Article 11).
  كذلك فإنه تماشياً مع القواعد المحدَّدة في القانوني الجنائي التركي تنص الفقرة الأولى من المادة 2 من ”القانون المتعلق بإنفاذ التدابير العقابية وتدابير الأمن“ على أن تنفَّذ القواعد المتعلقة بإنفاذ التدابير العقابية وتدابير الأمن دون أي تمييز على أساس العنصر أو اللغة أو الديانة أو العقيدة أو الجنسية أو اللون أو الجنس أو الرأي السياسي أو أي رأي آخر، أو العقيدة الفلسفية، أو الخلفية الوطنية أو الاجتماعية، أو المولد، أو المركز المالي والمراكز الاجتماعية الأخرى، ولا يُمنح أي شخص أية امتيازات خاصة في تطبيق ذلك القانون (للاطلاع على القواعد المتعلقة بالتمييز في قانون العمل، انظر المادة 11).
