  "(م) يقصد بتعبير "الفساد" أي فعل أو امتناع عن فعل غرضه اكتساب منافع أو امتيازات أو مزايا مادية أو غيرها بطريقة غير مشروعة استنادا الى منصب موظف عمومي، أو وضع السلطة الممثّلة، أو الصلاحيات الرسمية، أو الفرص المتأتية عن ذلك الوضع أو تلك الصلاحيات، ويقصد به أيضا رشوة الموظفين الرسميين المشار اليهم أعلاه من جانب أشخاص طبيعيين أو أشخاص اعتباريين، عن طريق عرض تلك المنافع أو الامتيازات أو المزايا أو الوعد بها أو إعطائها؛"
