  وحسـب مـا احتجـت بــه المحكمة الجنائية الدولية ليوغوسلافيا السابقة بشكـل مـُـفـْـحـِـم في قضية فـُـورونجيــا: ”لا يكفي مجرد التدخل بعد وقـوع التعذيب، عندما تكون السلامة البدنيــة أو المعنوية للإنسان قد تضررت ضررا لا يمكن علاجـه.

  وليست الدول ملزمة بحظر اللجوء إلى التعذيب والمعاقبة عليه فحسب، بل هي ملزمة أيضا بمنعه. ولا يكفي مجرد التدخل عقب ممارسة التعذيب بعد المس بالسلامة البدنية أو المعنوية للإنسان بشكل لا رجعة فيه.
