As a result, the secretariat of the Fund has undertaken to study those implications once the Court of Appeal has rendered its judgment in the case.125 It can be noted that the Federal Court of first instance in New York, in a judgment of January 2008, reached a different conclusion as regards the interpretation of article III.4 of the Convention in proceedings engaged by the Spanish Government against the American Bureau of Shipping in the context of the Prestige incident.
