(g) A principle or reasoning used by the Supreme Court to set aside a lower court's ruling is illustrated by the Criminal Division's decision to stay the execution of a death sentence where one of the persons entitled to claim retaliation was a minor descendant of the criminal. The Court ruled that the sentence should not be carried out until the person in question came of age, because of the possibility that he might be prepared to waive his claim, in which case the sentence would be commuted to one of payment of blood-money.
(ز) ومن المبادئ أو القواعد المقررة من المحكمة العليا للنقض والإقرار (الدائرة الجزائية) تأجيل تنفيذ الإعدام إن كان بين أولياء الدم القتيل فرع للجاني قاصراً حتى بلوغه وذلك لوقوع شبهة أن يعفي هذا القاصر بعد بلوغه فتسقط عقوبة الإعدام إلى الدية، وفي ذلك مصلحة ظاهرة للمتهم المدان.
