  • Article 358 of the Penal Code provides for “imprisonment for 1-3 years for the wardens and guards of prisons or other penal or disciplinary institutions if they admit a person or keep him beyond the legal term without a judicial writ or order”.
    وقد نصت المادة 358 من قانون العقوبات السوري "على الحبس من سنة إلى ثلاث سنوات لمديري وحراس السجون والمعاهد التأديبية أو الإصلاحية إذا قبلوا شخصاً دون مذكرة قضائية أو قرار أو استبقوه إلى أبعد من الأجل".
  • However, it is prohibited to publish investigation documents before they are read out at a public hearing and it is also prohibited to publish judicial writs or the proceedings of trials conducted in camera or the hearings of divorce and desertion actions or any material the publication of which is prohibited by the court (article 410 of the Penal Code).
    ولا يوجد في القانون ما يمنع الصحافة أو وسائل النشر الأخرى من حضور المحاكمات أو نقلها، غير أنه يمنع نشر وثائق التحقيق قبل تلاوتها في جلسة علنية، ومذاكرات القضاة، ومحاكمات الجلسات السرية، والمحاكمات في دعاوى النسب والطلاق والهجر، وما قضت المحكمة بمنع نشره (المادة 410 عقوبات).
  • The law does not prohibit the press or other information media from attending or reporting on trials. However, it is prohibited to publish investigation documents before they are read out at a public hearing and it is also prohibited to publish judicial writs or the proceedings of trials conducted in camera or the hearings of divorce and desertion actions or any material the publication of which is prohibited by the court (art. 410 of the Penal Code). The court may, on the basis of a substantiated decision, hold a trial in camera in the interests of public order or public morals.
    ولا يوجد في القانون ما يمنع الصحافة أو وسائل النشر الأخرى من حضور المحاكمات أو نقلها غير انه يمنع نشر وثائق التحقيق قبل تلاوتها في جلسة علنية ومذكرات القضاة ومحاكمات الجلسات السرية والمحاكمات في دعاوى النسب والطلاق والهجر وما قضت المحكمة بمنع نشره ( مادة 410 عقوبات ) ويمكن للمحكمة إن تجري المحاكمة سراً إذا خشيت على النظام العام أو الآداب العامة وبقرار معلل.
