  يحدد الدستور في المادة 65 منه أن "مدة مجلس النواب ست سنوات شمسية تبدأ من تاريخ أول اجتماع له، ويدعو رئيس الجمهورية الناخبين إلى انتخاب مجلس جديد قبل انتهاء مدة المجلس بستين يوماً على الأقل، فإذا تعذر ذلك لظروف قاهرة ظل المجلس قائماً ويباشر سلطاته الدستورية حتى تزول هذه الظروف ويتم انتخاب المجلس الجديد".
