The court held that the parties had agreed on a specific quality for the merchandise (a fact that the seller could not, under CISG, article 8, have been unaware of) and that clause 8 of the contract, relating to the maximum humidity level and the price reduction if the humidity exceeded 14 per cent, “is no more than a precaution in the event that the humidity exceeds 14 per cent within admissible limits in one or several consignments or in the event that the buyer accepts goods with excessive humidity for the purpose of maintaining the contract.
ورأت المحكمة أن الطرفين قد اتفقا على نوعية محددة للبضاعة (وهي حقيقة لا يمكن للبائع، ألا يكون على علم بها، بموجب المادة 8 من اتفاقية البيع) وأن البند 8 من العقد، الذي يحدد أقصى مستوى للرطوبة وينص على خفض السعر إذا تجاوزت درجة الرطوبة 14 في المائة، "ليس أكثر من تدبير وقائي في حال تجاوزت درجة الرطوبة نسبة 14 في المائة في إطار حدود مقبولة في شحنة واحدة أو عدة شحنات أو في حالة قبول المشتري بضاعة ذات معدل رطوبة مفرط بغرض الحفاظ على العقد.
