On the other hand, article 123 provides that “if any person causes damage to other people by engaging in operations that are greatly hazardous to the surroundings, such as operations conducted high above ground or those involving high pressure, high voltage, combustibles, explosives, highly toxic or radioactive substances or high-speed means of transport, he shall bear civil liability; however, if it can be proved that the damage was deliberately caused by the victims, he shall not bear civil liability”.
ومن ناحية أخرى تنص المادة 123 على أنه "إذا سبب أي شخص ضرراً للغير بالمشاركة في عمليات تكون خطيرة جداً للبيئة المحيطة، من قبيل العمليات التي تجري على مسافة مرتفعة عن الأرض أو تلك التي تنطوي على استخدام الضغط العالي أو الفولط العالي، أو آلات الاحتراق أو المتفجرات أو المواد العالية السمية أو المواد المشعة أو وسائط النقل العالية السرعة فإنه يتحمل المسؤولية المدنية عن ذلك؛ على أنه إذا ثبت أن الضرر أحدثه الضحايا عمداً فإنه لا يتحمل المسؤولية المدنية عن ذلك".
