  وتنص الدائرة الدستورية، في فتواها رقم 1155-94، على المساواة بين الأشخاص الذين تتكون منهم الأسرة، في قولها إن الأسرة تتألف من أفراد أحرار ومتساوين في الكرامة والحقوق أمام القانون.
• Progress was achieved in applying the principle of equality when the Constitutional Chamber issued the following interpretation concerning the text of the Constitution and legislation in general: “in order to prevent any future cases of inequality and discrimination that may occur through application of the Basic Charter or other existing legal instruments or through the exercise of the powers accorded to the Chamber under the Constitution, it is hereby resolved that whenever the term “man” or “woman” shall be used in legislation, it shall be regarded as synonymous with the word “person,” thus eliminating any possible gender-based “legal” discrimination. This change shall be applied by all public officials presented with any action whose resolution requires application of a regulation employing the aforementioned words”.
  وقد حدث تقدم في تطبيق مبدأ المساواة يتمثل في تفسير الدائرة الدستورية للنصوص الدستورية والتشريعية بوجه عام: “عملا على تجنب احتمال وقوع أشكال من عدم المساواة والتمييز في المستقبل عند تطبيق الميثاق الأساسي وغيره من الصكوك القانونية السارية، وعند ممارسة هذه الدائرة للسلطات التي خولها الدستور إياها، يُنص على أنه يجب، عند استخدام لفظتي “رجل” و “امرأة” في التشريعات، أن يفهم أنهما مرادفتان للفظة “شخص”، وبذلك ينتفي أي احتمال للتمييز “القانوني” القائم على الجنس، وهذا تصحيح يجب أن يطبقه جميع الموظفين العامين عندما تعرض عليهم أي حالة تتطلب تسويتها تطبيق قاعدة تستخدم فيها الألفاظ المشار إليها أعلاه”.
