• However, since it is apparent from a careful study of the last part of paragraph 1 and the second paragraph that the elements included in the chapeau are evidentiary factors, a classification of elements and means for demonstrating intent, these elements could be taken up in the Working Group on Rules of Procedure and Evidence in order to determine whether they should be embodied in a rule.
