With respect to the first ground, the degree of intermingling required is hard to quantify and has been variously described by different courts as involving a degree of intermingling that was hopeless or a practical impossibility to disentangle; that would require such time and expense to disentangle the interrelationships between the group members and the ownership of assets that it would be disproportionate to the result, or was so substantial that it would threaten the realization of any net assets for the creditors; or that the allocation of assets and liabilities between the relevant members was essentially arbitrary and without economic reality.
ففيما يتعلق بالسبب الأول، تعتبر درجة الاختلاط اللازمة صعبة التحديد كميا وقد وصفت من جانب المحاكم المختلفة بأشكال شتى، تشمل درجة من الاختلاط لا أمل في تفكيك تشابكها أو يتعذر عمليا فعل ذلك؛ أو يتطلب تفكيك الترابطات بين أعضاء المجموعة وملكية موجوداتها قدرا من الوقت والنفقات لا يتناسب مع النتيجة أو هو من الضخامة بحيث يعرّض للخطر تحقيق أي قيمة صافية للموجودات لصالح الدائنين؛ أو أن توزيع الموجودات والالتزامات بين الأعضاء المعنيين يتسم أساسا بطابع اعتباطي ولا يجسد واقعا اقتصاديا.
