The Comunidad Homosexual Argentina (Argentine Homosexual Community) (CHA) stresses the need to amend, make or repeal laws so as to secure recognition of the civic equality of gays, lesbians, transvestites, transsexuals, bisexuals and intersexuals. It mentions in particular several items that are pending: the amendment of Act No. 23.592 to make non-discrimination on grounds of sexual orientation or gender identity a part of national law; the passage of the national law on civil union and reform of the Marriage Act; repeal of the provincial codes criminalizing and punishing homosexuality and transvestism; a ban on discrimination in employment; the amendment of transvestites' and transsexuals' identity papers; the repeal of legislation blocking sex-change operations; amendment of the Ministry of Health resolution decrying and prohibiting blood donations to homosexuals and sex workers; and the passage of legislation guaranteeing single heterosexual women and lesbian mothers access to fertility treatment, and the explicit inclusion of sexual orientation and gender identity in the national Sex Education Act passed in 2006.
يسلِّط مجتمع المثليين جنسياً الضوء على أهمية تعديل التشريعات أو إلغائها أو سن غيرها تحقيقاً للاعتراف بالمساواة المدنية للمثليِّين والمثليات والمتخنثين والمحولين جنسياً وثنائيي الجنس وحاملي صفات الجنسين، ويذكر على وجه الخصوص أن الإجراءات التالية لا تزال قيد النظر: تعديل القانون رقم 23592 بشأن إدراج عدم التمييز على أساس الميل الجنسي والهوية الجنسية في القانون الوطني؛ واعتماد القانون الوطني للوحدة المدنية وإصلاح قانون الزواج؛ وإلغاء قوانين الجُنح أو المخالفات السارية في المقاطعات والتي تجرِّم وتعاقب المثليين جنسياً أو المتخنثين وحظر التمييز في العمل؛ وتعديل وثائق الهوية الخاصة المتخنثين والمحولين جنسياً؛ وإلغاء التشريع الذي يمنع عمليات تغيير الجنس؛ وتعديل قرار وزارة الصحة الذي يصِم التبرُّع بالدم للمثليين والمشتغلين/المشتغلات بالجنس ويمنعه؛ وكذلك اعتماد تشريعٍ يضمن حصول النساء مشتهيات الجنس الآخر غير المتزوجات والمثليات في علاج الخصوبة؛ وإدراج الميل الجنسي والهوية الجنسية إدراجاً صريحاً في القانون الوطني للتثقيف الجنسي الذي اعتُمد في عام 2006(16).
