The act of taking part in the diffusing of radiation and in the disintegration process of atomic nuclei is also considered a punishable offence in paragraph 3, which states “whoever diffuses radiation or takes part in the disintegration process of atomic nuclei in a manner to give damage to another person's life, health or property to an important degree, shall be sentenced to imprisonment from two to five years.” And finally, the fourth paragraph states “whoever, in disregard of his/her obligations to be careful and diligent, causes radioactive diffusion or disintegration of atomic nuclei during operations of a laboratory or a plant, shall be sentenced to imprisonment from six months to three years”.
وتنص الفقرة الثانية من نفس المادة كذلك على أنه إذا ارتكب العمل الإجرامي الوارد وصفه في الفقرة الأولى ضد عدد غير محدد من الأشخاص، يحاكم الشخص بالحبس لمدة لا تقل عن خمس سنوات.كما تعتبر المشاركة في نشر الإشعاع وفي عملية تفتيت النواة الذرية أيضا مخالفة يعاقب عليها وفق أحكام الفقرة 3، التي تنص على أن ”يحاكم كل من ينشر الإشعاع أو يشارك في عملية تفتيت النواة الذرية بطريقة تلحق ضررا كبيرا بحياة شخص آخر، أو بصحته، أو بممتلكاته، بالحبس لمدة تتراوح بين سنتين وخمس سنوات“.
