The dispute reached arbitration and, among the contentious issues was the validity of the settlement agreement, which the Arbitral Tribunal subsequently held valid on the grounds of equitable estoppel (i.e., the claimant was justified in expecting that the settlement agreement would be eventually approved in accordance with the Financial Regulations and Rules, and the United Nations was therefore precluded from denying the enforceability of the settlement agreement because such approval was not obtained).
